  1. Shortening of Automatic Work Permit Extension for TPS Holders


Several recent federal court orders compelled work permits to be extended for Temporary Protected Status ("TPS") holders from Ethiopia, Burma, and Syria.  Unfortunately, the extensions come with a setback. Those who apply to renew their work permits typically receive an automatic extension of their existing work permit.  The period used to last 540 days.  That is no longer the case.  TPS holders who filed their renewal application between July 22 and October 30 of 2025 will have their automatic renewal period reduced to just one year.


Meanwhile, TPS for South Sudan nationals has been terminated.


  1. H-2B Labor Certification Form


Department of Labor is revising the ETA-9142B form, which is used to apply for temporary labor certification for H-2B workers.  The proposed rule would also eliminate the ETA-9155, a registration form that has never been implemented.  DoL now seeks comment for this proposed rule. We will provide update if the new form comes to pass.
